Cyberstalking and Law in Malaysia

The above examples are known as cycerstalking.

Cyberstalking or online stalking is a way of harrasing (thresatening, false accusation, identity theft) someone by using technology. It also include the exploitation of the minors (it may be in terms of sexually or otherwise).

Victim can be man or woman or even children.

Real case in Malaysia; Lee David Clayworth, a Vancouver teacher  was cyberstalked by his Malaysian ex-girlfriend, Lee Ching Yan. She started to cyberstalked him as soon as they broke up. She sends him alsmost  200 messages to him everyday and sometime posted nude pictures of him with offending words. Clayworth took legal action against Yan and he won the case. Yan was found guilty of defamation under the Defamation Act 1957. However she left the country as soon as the arrest warrant was issued and she carried on cyberstalking  Clayworth for some time.

In Malaysia, there is no specific law pertaining to cyberstalking. Section 233 of the Communications and Multimedia Act 1998 (improper use of network facilities / service) can be regulated in cyberstalking offences;  however such harassment should  be in a form of electronic harassment which is obscene, indecent, false, menacing or offensive in character.  Punishment is imprisonment of maximum one year, or fine of maximum RM50,000 or both.

Unlike Malaysia , Singapore has introduced the Protection from Harrassment Bill 2014 to protect victims from harrassment and anti social behaviour. Anti social acts such as cyberstalking, bullying of children, sexual harassment in workplace and cyber harassment are now deemed illegal. If a person is found guilty based on the above offences, the person will be fined up to S$5,000.00 or a jail term not exceeding 12 months. Repeat offenders may face a fine up to S$10,000 and / or jail term of not more than two years.

Even though there are law to protect the cyberstalking victim, a stalker may change his/her profile to continue stalking the victim. Law can only be regulated if the stalker’s profile is known. The measure might not be implemented in cases where the offenders are anonymous.

Nev Schulman  is a very lucky person I can say. He did not lose any cash nor assets  however he did take the right decision by checking the background of the person he ‘loves’. A brave move by his instinct had saved him from being duped and scammed.

His decision also made him to create awareness  through his TV shows. He has provided vast information on love scam especially tips to identify love scammers which actually assist everyone who watches his show. One way in reducing online love scam; if not reducing at least it creates awareness among viewers to be more alert.

Also reminds me of another show host by Dr. Phil which also focuses on love scam issues. Thank you Dr. Phil!

Love Scam: A Real Life Story

Catfish

Ever heard of Nev Schulman? The guy who decided to do a TV show, usually airs on MTV, after he himself was caught in an internet deceit? No?

Well, here is the story.

In 2010, Nev Schulman met Megan Faccio through mutual friends on Facebook. The two quickly connected through flirty messages and lengthy phone calls and decided to give it a shot although they haven't met in person. As time passed by, Nev developed a sense suspiciousness in this new love affair and decided to give his lover a surprise visit in a rural area in Michigan. He brought along his brother and a friend to capture it all on film. To his surprise, he didn't meet the girl of his dreams but instead came face to face with a 'catfish' name Angela Wesselman-Pierce.

When confronted on why she did it? Angela claimed that the fake profile, along with other fake profiles to make her persona seemed legit, represented her life in which she wished she had. Nev then interviewed her husband on the possible reasons for this disgusting and despicable act. The husband, Vince, referring to her as 'catfish' said that this was necessary in order to keep marketable 'cods' active while in transit by the fishers. In other words, he meant that Angela, kept people active which was a sick attempt.

Nev Schulman is now engaged to girlfriend Laura Perlongo and are getting married soon. They announced that they are expecting a baby girl.

 

Nev Schulman still continues to produce and host the show Catfish (currently season 5) along with his friend Max Joseph. This show is to help people who are potentially the prey or victim of online love scam.

Anatomy of the Online Dating Scam

In this journal the author has provided a detailed anatomy on the online romance scam. How actually a scammer starts an online relationship and ends it. There are few stages in order for a scammer to successfully gets what he/she wants (mostly on monetary purpose).
 

Stage	Actions by scammer	How Scammer communicates with victim
1	The Profile: -          Attractive photographs -          Claims that their from US but working in UK -          Describes themselves as being well-off or a widow/widower with a child and looking for honest and trustworthy person	-          This man was so good-looking, he took my breath away. (female victim) -          She looked like a model, very attractive (male victim) -          Yeah, like a foundation or something like that. Make gas and oil foundation for…whole Europe, or…contact with another country. Very attractive. He was rich, important. (female victim)
2	Grooming: -          Scammer  will try to groom the victim, by increasing the intimacy in the relationship -          Syndicate member will convince victim on how much he/she love her and would like to have a permanent relationship	-          She said she loved me and asked me to marry her, so we were talking about a long-term commitment relationship in the first few weeks.  (male victim) -          He sent me a love poem every morning and we were on chat (IM) for hours every night and he called in the morning to say good morning and every night to tell me he loved me and would never let me go. (female victim) -          Next came the teddy bear with a banner on its chest stating “I Love You.” (female victim) -          We spoke for a week when I got my first bouquet of beautiful red roses. (female victims)
3	The Sting: -          Scammer will attempt to con the victim out of money and may ask for small amount of money first and then larger amount	-          And then she said, I’m coming over, I want the airfare…And she sorted all out the prices and everything herself.  As I say, she didn’t arrive because she had this accident and ended up in hospital over there. (male victim) -          When she called me 4 hours later she told, that she had been in an accident, hurt a little girl, which was in hospital in a coma. (male victim) -          His daughter got hurt in an attack by some militants and he asked me for money for medical bills.  (female victim)
4	Sexual Abuse: -          After obtaining the money the scammer may ask the victim to perform sexual act in front of webcam (2 main purpose ; one is for the scammers own amusement or as a material to blackmail the victim)	-
5	Revelation: -          Victim finally will realize that he/she has been scammed if there is no communication from the scammers after sending money -          Some victim may make a report/complain to the respective department	-

How Do Victims Feel After Being Scammed?

Devastated because loss of money and the person they loved (which was the scammer)

Deep feeling of ashamed and humiliation due to loss of money and cheated

Feeling embarrassed and guilty with family and friends due to poor awareness of love scam knowledge or too ignorance about it

Feeling loss of dignity

Feeling of demotivated to carry on their normal live

 

Under intense pressure after knowing they were cheated / betrayed

Victim will be very upset due to failure in relationship and also loss of  money and assets

Some victim cannot accept the reality that they have been scammed and thus try to look for “new friends” to share their bad and dreadful experience without knowing that the second wave of love scam comes back

Latest news on Love Scam, another Love Scam in Malacca on the 1st September 2016 involving a housewife and a lecturer. It believed to be scammed by an African syndicate. Both were in their early 40s and lost RM 721,000 and RM 402,000 respectively.

The basically used similar modus operandi as the previous post (newspaper cuttings by The Star); the syndicate member befriended the victim on Facebook and sweet talked them before persuading for cash.

Newspaper Articles On Love Scam in Malaysia

The above are some newspaper articles related with online romance scam in Malaysia. These are separate issues and cases caught this year by the Royal Malaysia Police. Most scammers involved are Nigerians, Cameroonian  and African. All the victims are Malaysian and were cheated by scammers through social medias such as Facebook, Tagged, Twitter and online dating sites. The scammers has their own special modus operandi by creating fake profiles by using someone else picture especially  stolen pictures of real military personnel.
